GENERAL TERMS AND CONDITIONS

1. Scope

The following terms and conditions apply to all orders made through our online shop. Our online shop is aimed exclusively at consumers.

Consumer is any natural person who concludes a legal transaction for purposes which cannot be attributed primarily to his commercial or self-employed professional activity. Entrepreneur is a natural or legal person or a partnership with legal rights which, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

Only orders from customers who have reached the age of 18 can be accepted.

By subsmitting the products in the online shop, we make a binding offer to conclude the contract for these items. You can first add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided for and explained in the order process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order, you will receive a confirmation by e-mail.

The language(s) available for the conclusion of the contract: German, English and Spanish.

We save the contract text and send you the order data and our general terms and conditions in text form. You can view the contract text in our customer login.

4. Right of withdrawal for consumers

The following right of withdrawal exists only for consumers in distance selling:

Cancellation – Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.

by means of a clear statement (e.g. a letter or e-mail sent by post) of your decision to withdraw from this contract. You can use the attached model withdrawal form, but this is not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undisclosed and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise; under no circumstances will you be charged any fees for this repayment. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the revocation of this contract.

The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, characteristics and functioning of the goods.

6. Prices and shipping costs

The prices shown are final prices incl. shipping costs (within Germany).

For orders from other European countries, the prices quoted are the following, plus shipping costs.  Pursuant to Section 19 of the UStG, we do not charge VAT and therefore do not show it (small business status). TASHAY charges for the countries Belgium, Denmark, France, Luxembourg, Monaco, Netherlands, Austria, Poland, Czech Republic, Andorra, Italy, San Marino, Sweden, Slovakia, Slovenia, Spain, Hungary, Vatican City, Bulgaria, Estonia, Finland, Greece, Ireland, Croatia, Latvia, Lithuania, Malta, Portugal, Romania, Cyprus a shipping share of 10 €.

For orders from the Non EU (Liechtenstein, Switzerland and United Kingdom) the prices are the indicated plus shipping costs (17€). 

For all other countries, please contact us. We are happy to make an individual offer for your delivery. In the case of deliveries of goods outside the European Union, import duties (customs duties) may apply. We do not pay any customs costs.

Please note that the postage for defect-free returns is borne by the customer (see cancellation instructions).

7. Terms of delivery

For orders within Germany and for payment by credit card, PayPal or Sofort at Klarna, unless otherwise stated in the offer, the goods will be delivered within 3-5 working days after receipt of payment.

If you order from other European countries and from the non-EU (Liechtenstein and Switzerland) and when you pay by credit card, PayPal or Sofort at Klarna, unless otherwise stated in the offer, the goods will be delivered within 3-14 working days after receipt of payment.

Liability for delay in delivery is excluded.

8. Payment

In our shop, the following payment methods are generally available to you:

Paypal

During the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment order to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. Further information can be obtained during the ordering process.

Credit card via PayPal

If you have chosen the credit card payment method, you do not need to be registered with PayPal in order to pay the invoice amount. The payment transaction will be carried out by your credit card company at PayPal’s request immediately after confirmation of the payment order and after your legitimation as a legitimate cardholder and will be charged to your card. Further information can be obtained during the ordering process.

Direct debit via PayPal

If you have chosen the direct debit payment method, you do not need to be registered with PayPal in order to pay the invoice amount. By confirming the payment order, you issue a direct debit mandate to PayPal. PayPal will inform you of the date of the account charge (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment order, PayPal invites its bank to initiate the payment transaction. The payment transaction will be executed and your account will be debited. Further information can be obtained during the ordering process.

Direct bank transfer

If you choose this payment method, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.

9. Retention of title

The goods remain our property until full payment has been made.

10. Transport Damage

If goods are delivered with obvious transport damage, please complain to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance company.

11. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability law for defects shall apply.

In the case of used goods, the following applies: if the defect occurs after the expiry of one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

The above limitations and shortening of time limits do not apply to claims arising from damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body or health
  • in the event of intentional or grossly negligent breach of duty as well as malice
  • in the event of a breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations)
  • within the scope of a guarantee promise, if agreed or
  • to the extent that the scope of application of the Product Liability Act is opened.

12. Liability

We are always liable without limitation for claims due to damages caused by us, our legal representatives or vicarious agents.

  • in case of injury to life, body or health
  • in the event of intentional or grossly negligent breach of duty
  • in the case of warranty promises, if agreed, or
  • to the extent that the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely, (cardinal obligations) by slight negligence on the part of us, our legal representatives or vicarious agents, the liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.

In addition, claims for damages are excluded.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found here. We are not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.
